These Terms and Conditions (“Terms”) govern the sale of products by RMA Active, a trading name of Roma Medical Aids Limited, through the website www.rmaactive.co.uk (“Website”).

By accessing this Website or placing an order with us, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use this Website or purchase products from us.

These Terms apply to all purchases made through our Website and form the entire agreement between you and Roma Medical Aids Limited in relation to your purchase unless otherwise agreed in writing.

Nothing in these Terms affects your statutory rights under applicable UK consumer protection legislation.

3. Eligibility to Purchase

By placing an order through our Website you confirm that:

  • You are at least 18 years of age.

  • You are legally capable of entering into a binding contract.

  • The information you provide during checkout is accurate and complete.

  • You are purchasing products for lawful use.

If we reasonably believe an order has been placed fraudulently or contains inaccurate information, we reserve the right to refuse or cancel the order.


4. Products

We sell new electric bicycles (eBikes) directly to consumers through our Website.

We do not currently sell:

  • Used eBikes

  • Refurbished eBikes

  • Accessories

  • Third-party marketplace products

All products sold through our Website are supplied directly by Roma Medical Aids Limited.

We reserve the right to discontinue products or amend specifications without prior notice where necessary.


5. Product Information

We take reasonable care to ensure that product descriptions, specifications, dimensions, colours, photographs and technical information displayed on our Website are accurate.

However:

  • Product images are for illustration purposes only.

  • Colours may appear differently depending on your monitor or mobile device.

  • Minor cosmetic or specification changes may occur during manufacture.

  • Manufacturers may improve or update components without notice where this does not materially affect the product’s intended performance.

Any weights, measurements or dimensions shown are approximate.

If we discover that information published on our Website is materially incorrect, we reserve the right to correct the information and, where appropriate, contact affected customers before dispatch.


6. UK eBike Compliance

All eBikes sold by RMA Active are supplied to comply with applicable UK legislation governing Electrically Assisted Pedal Cycles (EAPCs) at the time of manufacture.

Customers must not modify, tamper with or alter the electrical or mechanical systems of an eBike in a manner that causes it to exceed legal limits or otherwise makes it unlawful to use on public roads or places.

Unauthorised modifications may:

  • invalidate the manufacturer’s warranty;

  • invalidate any warranty provided by RMA Active;

  • affect the safety of the eBike;

  • render the eBike unlawful to use in certain circumstances.

Any such modifications are undertaken entirely at the customer’s own risk.


7. Availability

All products are offered subject to availability.

Although we endeavour to keep our Website up to date, occasionally products may become unavailable after an order has been placed.

If we cannot fulfil your order because a product is unavailable, discontinued or affected by circumstances beyond our reasonable control, we will contact you as soon as reasonably practicable and issue a full refund for any unavailable items.

We shall not be liable for any indirect or consequential loss arising from the unavailability of a product.


8. Pricing

All prices displayed on our Website are shown in Pounds Sterling (£) and include VAT where applicable unless otherwise stated.

Delivery to eligible mainland UK addresses is provided free of charge.

Prices may change at any time without notice. However, price changes will not affect orders that have already been accepted.

Despite our best efforts, errors may occasionally occur.

If we discover that:

  • a product has been incorrectly priced;

  • incorrect promotional information has been displayed; or

  • obvious pricing errors have occurred,

we reserve the right to cancel the order prior to dispatch.

If payment has already been taken, a full refund will be issued using the original payment method.


9. Payment

Payment is taken immediately when an order is placed through our Website.

We accept the payment methods displayed during checkout.

You confirm that:

  • you are authorised to use the selected payment method;

  • all payment information supplied is accurate;

  • sufficient funds are available to complete the transaction.

If payment authorisation fails, we will not process your order.

Ownership of the eBike remains with Roma Medical Aids Limited until payment has been received in full.


10. Placing an Order

Orders may be placed through our Website at any time.

After submitting your order, you should receive an acknowledgement that we have received it. This acknowledgement does not constitute acceptance of your order.

Your order represents an offer to purchase the products selected.

We reserve the right to decline any order, including where:

  • products are unavailable;

  • payment cannot be authorised;

  • fraudulent activity is suspected;

  • pricing errors have occurred;

  • delivery cannot be made to the requested address;

  • the order otherwise cannot reasonably be fulfilled.

If your order cannot be accepted after payment has been received, a full refund will be processed.


11. Order Acceptance

A legally binding contract between you and Roma Medical Aids Limited is formed when we accept your order.

Until that point, we reserve the right to decline or cancel the order for any legitimate reason.

Where an order is cancelled by us after payment has been taken, we will refund the full amount paid.


12. Customer Order Cancellation

If you wish to cancel your order before it has been processed, you must notify us within 2 hours of placing your order.

Cancellation requests should be sent to:

Once an order has entered processing or has been prepared for dispatch, cancellation may no longer be possible.

This policy is separate from, and does not affect, your statutory rights relating to distance sales under applicable UK legislation.


13. Delivery Area

We currently deliver eBikes only to eligible mainland UK addresses.

Delivery is available to:

  • England

  • Wales

  • Scotland (excluding the Scottish Highlands and Islands)

We do not currently deliver to:

  • Northern Ireland

  • Scottish Highlands

  • Scottish Islands

  • Isle of Man

  • Isle of Wight

  • Channel Islands

  • Scilly Isles

  • Any other offshore UK islands or locations that fall outside our standard delivery network.

If you are unsure whether your address falls within our delivery area, please contact us before placing an order.

We reserve the right to decline orders where delivery cannot reasonably be completed.


14. Delivery Charges

Delivery is provided free of charge to all eligible mainland UK addresses.

No minimum order value applies.

Any future promotional delivery offers will not affect orders already placed.


15. Delivery

Our eBikes are delivered partially assembled.

Estimated delivery times shown on our Website or otherwise communicated to you are estimates only and are not guaranteed.

While we make every reasonable effort to deliver within the estimated timeframe, delays may occasionally occur due to circumstances outside our reasonable control, including but not limited to courier delays, adverse weather, supply chain disruption, traffic conditions, industrial action or other unforeseen events.

Dispatch confirmation emails and parcel tracking information are not routinely provided.

Delivery will be made to the address supplied during checkout. It is your responsibility to ensure that the delivery address is accurate and that suitable access is available.

If delivery cannot be completed because no one is available to accept the delivery or because access is restricted, additional delivery charges may apply where a further delivery attempt is required.

Risk in the eBike passes to you once it has been delivered to the delivery address you provided.

You should inspect the packaging and the eBike as soon as reasonably practicable after delivery. If you believe your order has been damaged during transit or is incomplete, please contact us promptly at sales@romamedical.co.uk and, where possible, provide photographs of the damage so that we can investigate and resolve the issue as quickly as possible.

Nothing in this section limits your statutory rights in relation to goods that arrive damaged, are faulty, or do not conform to your order.

 


16. Assembly and Initial Inspection

Your eBike is supplied partially assembled and must be fully assembled before it is ridden.

Upon delivery, you should carefully unpack the eBike and inspect it for any obvious signs of damage that may have occurred during transit.

Before using the eBike, you are responsible for ensuring that:

  • the handlebars are correctly aligned and securely tightened;

  • the pedals are correctly fitted;

  • the front wheel (where applicable) is correctly installed and secured;

  • the saddle and seat post are correctly adjusted and tightened;

  • the brakes operate effectively;

  • the tyres are inflated to the recommended pressure;

  • all nuts, bolts and quick-release mechanisms are correctly tightened;

  • the battery is correctly installed;

  • all electrical functions operate correctly.

The eBike must not be ridden until all assembly has been completed and the bicycle has been checked to ensure it is safe for use.

If you are uncertain about any aspect of assembly, we strongly recommend that the eBike is assembled and inspected by a competent bicycle mechanic before its first use.

Failure to correctly assemble the eBike may result in injury, damage to the product and may affect warranty coverage where the damage results from incorrect assembly.


17. Safe Use of Your eBike

You are responsible for operating your eBike safely and in accordance with all applicable laws and regulations.

You should always:

  • wear an appropriate cycle helmet;

  • obey the Highway Code;

  • ride responsibly and with due care for other road users and pedestrians;

  • regularly inspect your eBike for signs of wear or damage;

  • maintain appropriate tyre pressures;

  • ensure brakes are functioning correctly before every ride;

  • use lights and reflectors where legally required;

  • ensure the battery is adequately secured before riding.

The eBike should not be used if you believe any component may be damaged or unsafe.


18. Customer Responsibilities

To ensure safe operation and preserve warranty coverage, you agree to:

  • use the eBike only for its intended purpose;

  • follow all operating and maintenance instructions supplied with the product;

  • carry out routine maintenance appropriate for the type of use;

  • store the eBike in a secure and dry location whenever reasonably possible;

  • keep the battery charged in accordance with the supplied instructions;

  • use only approved replacement batteries and chargers supplied or recommended by RMA Active;

  • stop using the eBike immediately if you suspect a fault affecting safety.

You are responsible for ensuring that anyone using the eBike is competent to do so safely.


19. Prohibited Modifications

The following modifications are not permitted and may invalidate your warranty:

  • increasing the motor power;

  • altering the speed limitation;

  • fitting non-approved electrical components;

  • modifying or bypassing the controller;

  • modifying the battery management system;

  • fitting incompatible batteries or chargers;

  • altering the frame structure;

  • removing safety devices;

  • making any modification that causes the eBike to no longer comply with UK legislation.

Any damage resulting from unauthorised modifications will not be covered under warranty.


20. Lithium-Ion Battery Safety

Our eBikes are fitted with rechargeable lithium-ion batteries.

Lithium batteries require careful handling.

To reduce the risk of damage or injury, you should:

  • use only the charger supplied with the eBike or an approved replacement charger;

  • charge the battery indoors in a dry, well-ventilated area;

  • keep the battery away from excessive heat, naked flames and moisture;

  • disconnect the charger once charging is complete;

  • store the battery in accordance with the user manual;

  • keep batteries away from children.

You should not:

  • dismantle the battery;

  • puncture or crush the battery;

  • expose the battery to fire;

  • immerse the battery in water;

  • attempt to repair the battery yourself.

If the battery becomes damaged, swollen, overheated or behaves unusually, discontinue use immediately and contact RMA Active.

Replacement batteries and chargers are available directly from us.


21. Battery Care

Battery performance naturally reduces over time through normal use.

Factors affecting battery life include:

  • charging frequency;

  • storage conditions;

  • riding style;

  • environmental conditions;

  • age of the battery.

Normal reduction in battery capacity over time is not considered a manufacturing defect.

To maximise battery life, customers should follow all charging and storage recommendations supplied with the eBike.


22. Consumer Cancellation Rights

If you purchase an eBike from our Website as a consumer, you generally have the right to cancel your purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

You may cancel your purchase within 14 days beginning on the day after you receive your eBike.

To exercise your right to cancel, you must clearly notify us by email at:

You do not need to provide a reason for cancellation.

Once cancellation has been accepted, you must return the eBike to us within the time required by law.

These statutory cancellation rights are separate from our own order cancellation policy.


23. Condition of Returned Goods

Customers have the right to inspect an eBike in the same manner that they would reasonably inspect it in a retail showroom.

However, customers must take reasonable care of the product while it is in their possession.

We reserve the right to reduce any refund where the value of the product has been diminished due to handling beyond what is reasonably necessary to establish its nature, characteristics or functioning.

Examples include, but are not limited to:

  • riding the eBike outdoors;

  • excessive mileage;

  • scratches or cosmetic damage;

  • crash damage;

  • missing components;

  • damaged packaging that prevents safe transport;

  • modifications;

  • signs of misuse.

Inspection indoors on a clean, dry surface is generally considered reasonable.


24. Returns Procedure

If you wish to return an eBike, you must first contact us using:

Returns should not be sent without prior authorisation.

We may provide instructions regarding packaging, collection or return arrangements.

The customer is responsible for ensuring that returned goods are packaged safely to prevent damage during transit.

Where products are returned because they are no longer wanted, the customer is responsible for the cost of returning the goods unless otherwise agreed.

If a product is found to be faulty or has been supplied incorrectly, we will arrange an appropriate remedy in accordance with your statutory rights.


25. Refunds

Where a refund is due, it will be made using the original payment method wherever possible.

Refunds will normally be processed once:

  • returned goods have been received; or

  • satisfactory evidence of return has been provided, where appropriate.

Processing times may vary depending upon your payment provider.

If a deduction is made because the value of returned goods has been reduced through excessive handling, we will explain the reason for the deduction.


26. Warranty

RMA Active warrants its eBikes against defects in materials and workmanship from the date of delivery for the following periods:

Motor 12 months
Battery 12 months
Electrical Components 12 months
Charger 12 months

This warranty is provided in addition to, and does not affect, your statutory rights under applicable UK consumer protection legislation.


Warranty Exclusions

The warranty does not cover:

  • normal wear and tear;

  • tyres;

  • inner tubes;

  • brake pads;

  • brake discs;

  • chains;

  • sprockets and cassettes;

  • cables;

  • bearings;

  • grips;

  • pedals;

  • saddles;

  • cosmetic damage that does not affect performance;

  • accidental damage;

  • crash damage;

  • misuse or abuse;

  • corrosion;

  • water damage resulting from improper use or storage;

  • failure to maintain the eBike in accordance with the user manual;

  • use of non-approved chargers or batteries;

  • unauthorised repairs;

  • unauthorised modifications;

  • commercial hire or rental use unless agreed in writing;

  • damage caused by transportation after delivery;

  • damage resulting from failure to follow assembly instructions.

Normal battery capacity reduction through age and use is not covered by the warranty.


27. Warranty Claims

If you believe your eBike has developed a fault covered by warranty, please contact:

You may be asked to provide:

  • proof of purchase;

  • photographs;

  • videos;

  • the serial number of the eBike;

  • a description of the fault.

Where necessary, we may require the eBike or the affected component to be returned for inspection before deciding whether a repair, replacement or other appropriate remedy is available under the warranty.

No repairs should be undertaken without our prior authorisation, as unauthorised repairs may invalidate the warranty.

 


28. Intellectual Property

Unless otherwise stated, all content available on this Website is the property of Roma Medical Aids Limited or is used under licence.

This includes, but is not limited to:

  • the RMA Active name;

  • logos and branding;

  • photographs;

  • product images;

  • graphics;

  • text;

  • product descriptions;

  • videos;

  • circumstances outside our reasonable control.

Where products are purchased for domestic consumer use, nothing in these Terms limits your statutory consumer rights.

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.
